The Jamaican extradition enquiry - was it worth it?
As the Dudus/Manatt Enquiry comes to an end in Jamaica, one wonders if the well publicised and talked about enquiry was worth it -- not only in terms of its high cost, but the verbal abuse and clashes between lawyers, politicians, and even public servants.
Even those who advocated the setting up of the commission of enquiry felt that the exercise was not worth it -- the entire proceedings turned out to be a farce, a gimmick, and a platform to criticise and embarrass government officials, including the head of government, prime minister Bruce Golding, and the administration's chief legal advisor, the attorney general and minister of justice Dorothy Lightbourne.
Reports from Kingston state that the setting up of the commission of enquiry was political suicide for Prime Minister Bruce Golding and his Jamaica Labour Party administration.
People's National Party's lawyer, K.D. Knight QC, was on centre stage, using his legal position to embarrass Golding and Lightbourne, who had no choice but to take the "blows" and answer the questions, although the same questions were repeated over and over and at one stage the prime minister refused to answer after being accused of being a liar.
Political analyst Kevin Chang said that Knight's behaviour has distracted from the issues being probed at the proceedings and said that the Queen's Counsel’s behaviour was out of order and he was rude to the prime minister, the minister of justice and others. Chang made a comment that raised eyebrows when he said, "The commissioners have also been timid about making firm rulings against Knight for fear of appearing biased because they were chosen by government."
Why should these honourable and distinguished members of the Commission be timid? Knight is so powerful. He is a senator, a top notch lawyer and served as minister of foreign affairs and foreign trade as well as minister of national security, but that does not give him licence to bully his way.
He has certainly transformed the enquiry into a different direction, instead of trying to ascertain the reason for the delay in extraditing Coke, and if it was the government of Jamaica retained the law firm of Manatt, Phelps and Phillips or the Jamaica Labour Party (JLP), and who should be blamed for the death of more than 70 persons.
Lightbourne made some serious statements that should be tested when she blamed the deputy director of public prosecutions Jeremy Taylor and solicitor general Douglas Leys.
However, what was worse was the battering of the prime minister by KD Knight and at times milking the enquiry for all the political fuel he could wring out of it. Surely Golding, before he set up the commission, must have thought that he would have to testify and he would be cross-examined.
One commentator who was at the enquiry said, "I felt ashamed, seeing him being visibly rankled and literally crying out." The commentator asked, "Did he not know that was Knight's objective? To psychologically destabilise him, to up his pressure, to get him red in the face and then to do so in front of the nation. Did he not see it coming?”
The entire fiasco was being televised for the entire nation to see. Was that a good move?
The Jamaica Council of Churches has also weighed in and chided Knight and others for their "tasteless behaviour" and comments at the enquiry.
The government has allocated JA$37 million for the enquiry, but another $21 million has been added to it and this might not be enough because the exercise has taken more than double the time it had anticipated, no doubt because of the line of cross examination.

Were OECS voices heard at the CARICOM heads of government summit in Jamaica?
It is approximately eight months since the summit of CARICOM heads was held in Montego Bay, Jamaica. Since then, Jamaica’s Bruce Golding has passed the torch to a struggling Tillman Thomas of Grenada, who might soon have to face a revolt of his National Democratic Congress (NDC).
Since assuming the chairmanship, Thomas has showed some interest in the organization and it will be interesting to watch how he handles the appointment of the new Secretary General for the Secretariat; appointment of a new Chief Justice for the Caribbean Court of Justice (CCJ) and of course his own personal challenge of taking Grenada into the CCJ. These are interesting times and the region is watching closely.
The 56th Organization of Eastern Caribbean States (OECS) meeting recently held in Grenada seemed to have had great success. The only grumbling is that Antigua’s Baldwin spent too much time gazing in the skies hoping that the breakfast invitation from Barack and Michelle would arrive after a long pigeon journey from Washington to Mt Obama and then to the Botanical Gardens in Grenada. The pigeon arrived empty handed and a disappointed Baldwin lost interest in the Assembly.
With the growing popular uprisings in the Middle East, North Africa and Iran’s misguided decision to send naval ships through the waters of the Suez Canal, one can only assume that Washington is so engaged and concerned with these fast evolving events that the White House invitation will not arrive in the immediate future.
As Prime Minister Denzil Douglas of St Kitts and Nevis has stated, the leaders at the CARICOM inter sessional meeting that ended in Grenada recently needed to address their time in a process of careful analysis, deep discussions and the development of a strategic plan to guide the organization in future years. As Douglas lamented, he was hopeful that at the inter sessional meeting CARICOM leaders would channel their energy on the many issues facing the region.
While not dismissing Antigua’s concern about the popular uprising in Libya, the Republic of Haiti’s pending return by former president Aristide, who was kidnapped and forced into exile in South Africa, must be addressed by the region’s leaders. The despicable and vulgar action by the United States of America, which resulted in the abandonment of Aristide in a notorious and corrupt nation known as the Central African Republic, should have been strongly criticized by the CARICOM leadership.
Unfortunately, they went into mute mode and, like roosters, it took courage and principled leadership by former Jamaican prime minister; P.J.
Patterson to rescue Aristide from the corrupt African nation until South Africa was able to complete all logistical arrangements to welcome their new guest. PJ, Randy Robinson, Congresswoman Maxine Walters and others must be commended for rescuing Aristide from the Central African Republic.
The CARICOM leadership has no other alternative but to support Aristide’s pending return to his native Haiti. This is not the time to echo or repeat the voice of the United States State Department media frontline man P.J Crowley as to whether Aristide’s return will be helpful. Was Duvalier’s recent return to Haiti helpful? PJ Crawley should also give us a one liner about the State Department’s position on this notorious and repressive dictator whom the United States supported for many years. Aristide’s welcome must be hailed by our leaders to his native birth land and should even go further to ensure that the region becomes part of his security detail. This is the time to show the courage and leadership that Douglas called for and there should be no retreat. Aristide requires the region’s full support.
Since the rigged and shameless elections in Haiti. There are four frequent questions being asked about CARICOM’s Mission in Haiti. These are: (1) what is the specific role and purpose of the CARICOM Mission in Haiti? (2) What specific and concrete outcomes have been achieved by its presence and what specifically has the Georgetown Secretariat benefitted by virtue of their presence in Haiti? (3) Who is funding the CARICOM Mission in Haiti? (4) When will the Mission come to an end? What is the reporting mechanism? Who reports to whom and how are CARICOM governments engaged in this Mission? These questions need to be answered.
As the CARICOM inter sessional assembly became a reality in Grenada last weekend, there are still cries from OECS leaders expressing their concerns about uncontrollable crime and lawlessness in their jurisdiction.
At the Jamaica summit, Skerrit of Dominica and Spencer of Antigua suggested that Jamaica might be in a position to assist, given the nation’s experience with gangs and garrison control. Unfortunately, the suggestion fell on deaf ears. Many of the OECS have since retreated to their old colonial tactics of recruiting foreign sideline retired police officers to manage national security initiatives. The OECS region requires the active assistance and intervention of the More Developed Countries on crime and lawlessness in their jurisdiction.
In conclusion, drug interdiction and the presence of foreign fleets in our waters are important security measures; however, leaders need to identify other mechanisms that will rebuild capacities in our police forces and other security agencies. With a credible vision on crime, our leaders are also urged not to shy away from examining other key and important strategic security issues which include:
-- The role and function of IMPACS. Can this organization seriously contribute to the containment of crime and lawlessness in the CARICOM region or is it just another CARICOM regional organ that has found favour from foreign multilateral friends?
-- What can the Barbados based CEDERA contribute to crime containment and other national security issues? What direct and specific impact will the recent CARICOM agreement generate on crime and lawlessness in the region?
-- What is the current status of the Regional Security Service? Should this organization be re-examined or purged so thus resulting in a new and progressive organizational model that reflects global reality?
-- Can Jamaica assist in the restructuring of the Regional Security Service? How about Jamaica giving a secondment to the region by one of its capable national security team? Someone like Novelette Grant or Glenmore Hinds?
Crime and lawlessness need to be seriously tackled in the region.

A Tale Of Two Extraditions

The US government demanded that Jamaican Prime Minister Bruce Golding extradite a drug dealer. When Venezuela made similar demands on Washington, for arguably the Hemisphere’s most notorious terrorist, the Justice Department brushed off the request.
Compare the recent arrest in Jamaica of “Dudus” (Christopher Coke) to stand trial in New York for drug and arms trafficking to Washington’s response to Venezuela’s extradition petition for Luis Posada Carriles, aka the Osama bin Laden of the Western Hemisphere for plotting the October 6, 1976 bombing of a Cuban commercial airliner over Barbados. All 73 crew and passengers died.
Evidence abounds pointing to his culpability including declassified cables from the CIA. An October 12, 1976 CIA cable from Caracas states that “Posada was overheard to say that `Now we are going to hit a Cuban airplane’.”
22 years later, Posada told NY Times reporters Ann Bardach and Larry Rohter (July13, 1998) he had orchestrated a series of hotel bombings in Cuba to dissuade tourism. An Italian tourist died in one of the blasts.
Posada’s captured underlings – arrested by police after the bombs exploded -- named him as the criminal author. A recent New Jersey Federal Grand Jury gathered evidence showing Posada used money and personnel from Miami to carry out the hotel bombings.
However, instead of charging him with terrorism and conspiracy to commit murder Justice invented a legal inanity and charged Posada with immigration fraud: lying to US officials when he entered the United States in 2004. Compare this dallying with a bona fide terrorist to the “extradite Dudus or else” position taken with Jamaica’s government. Jamaican security forces killed some 70 residents trying to capture Dudus in his Kingston neighborhood. But Washington refuses to extradite the mass murderer Posada.
As Washington intimidated Jamaica’s government over Dudus the drug and gun peddler they ignored the fact that millions of US citizens consume drugs imported from Jamaica; and US banks that launder money from the trade.
But a more sinister fact underlines the Dudus and Posada cases. Both of criminals owe their careers to Washington’s 50 year war against Cuba.
In 1976, Prime Minister Michael Manley told me during the filming of his campaign film, of an unusual invitation. In January 1976, Secretary of State Henry Kissinger, vacationing at the Rockefeller estate in Jamaica, invited Manley to visit to convince him to withdraw his support of Cuban troops in Angola. (Castro had sent troops there in October 1975 at the Angolan government’s request to stop CIA and South African invasions of that newly independent African country.) Kissinger’s grimaced as Manley reiterated his backing for Castro’s Africa policies.
“He then assured me,” Manley chuckled, “I should not worry about CIA activities in Jamaica.” But, he said, some interesting “coincidences” occurred shortly after the visit.
Norman Descoteaux arrived to head the CIA station in Kingston, an expert on destabilization campaigns in South America. As journalists arrived in Kingston to cover World Bank and IMF meetings, violence exploded in Kingston’s western slums. Tourists exposed to the media accounts would have had good reason to change plans for a Jamaican vacation. Soon afterward, security forces arrested armed youth who admitted they were getting trained to attack the government, Other gunmen killed two policemen.
Manley applied “heavy manners.” He revived a special court permitting the arrest without bail of persons with unlicensed firearms and formed unarmed, community self-defense groups. The CIA learned from its “mistakes,” however.
In Manley’s 1980 campaign for re-election, the violence far exceeded the 1976 carnage. I heard the nightly roar of gunfire in Kingston streets and filmed people weeping for their dead kin outside a recently torched housing project in a pro-Manley district. Thousands died in that pre-election period. The gangs bought by Manley’s opponent, Edward Seaga, and the CIA successfully destabilized the government.
Manley lost; Seaga became Prime Minister and the first foreign visitor to the Reagan White House.
Dudus’ father, Lester, emerged from the violence campaigns as head of the Shower Posse (they sprayed their victims with automatic weapons) in West Kingston. Having secured a political alliance with the winner in 1980, and possessing arms from the CIA, he began dealing drugs and weapons.
So powerful had the posse become – now under Dudis the son -- that Labor Party chief and now Prime Minister Bruce Golding tried to defuse the US extradition request for nine months. The State Department assured him that continued resistance would endanger US-Jamaican relations (aid money) and his political career.
But Washington sneers at Venezuelan pressure just as George H. W. Bush in 1990 derided his own Justice Department’s strong advice against pardoning Orlando Bosch, Posada’s co-conspirator in the airline bombing. Judges play along with the charade. One magistrate, without fact or testimony, ruled against Posada's extradition to Venezuela because Posada’s lawyer claimed Venezuela would torture him “while in custody."
The Caribbean states (Caricom) called the 1976 Cubana airline bombing “terrorism in Caribbean airspace.” Ricky Siingh writing in the Jamaica Observer said “no double standards on implementation of bilateral extradition treaties should be permitted on the part of Jamaica and the USA in the case of Christopher Coke; or that involving Venezuela and America for the extradition of Posada.” June 20?? Accusing the United States of double standards is like charging a prostitute with having sex. Indeed, US behavior in the Posada case gives hypocrisy a bad name.
Hubris with Jamaica over a druggie! The stalling game played with Venezuela over a terrorist! Wouldn’t it be nice to live in a nation of law?

Jamaica: State of public emergency called
Jamaica Observer:
PRIME Minister Bruce Golding has declared a state of public emergency, limited to sections of Kingston and St Andrew effective 6:00 pm today.
Golding said that based on the advice of the security forces, the action has been taken so as to ensure public safety.
The state of emergency was called following an emergency meeting of the Cabinet at 2.00 pm today.
"The Cabinet took the decision to advise the Governor General to issue a Proclamation pursuant to Section 26 of the Constitution declaring that a state of public emergency exists in the parishes of Kingston and St Andrew," a release from the Office of the Prime Minister said.
The proclamation shall remain in force for a period of one month unless extended by the House of Representatives or earlier revoked.
Meanwhile, gunshots continue to be fired in West Kingston and roadblocks have now been mounted as far as the intersection of Maxfield Avenue and Spanish Town Road.

Jamaica's Prime Minister Bruce Golding admits lobby on behalf of drug accused Christopher ‘Dudus’ Coke

KINGSTON, Jamaica, Wednesday May 12, 2010 – A controversy surrounding efforts by the United States to have a drug accused extradited, and the Jamaica government’s resistance to those moves, yesterday became even more contentious as Prime Minister Bruce Golding admitted that he gave the nod for a law firm to be hired to lobby the US government on the extradition issue.
His admission was met with strong criticism across the floor of Parliament, even as he insisted the company was hired and paid by his Jamaica Labour Party (JLP) and not the government.
Golding came clean on his involvement in the matter following weeks of allegations and claims that the government had engaged the services of US law firm Manatt, Phelps & Phillips to intervene as the US pushed its request for the extradition of Christopher ‘Dudus’ Coke, a member of the JLP stronghold of West Kingston who is wanted on gun and drug charges in the US.
“I sanctioned the initiative, knowing that such interventions have in the past proven to be of considerable value in dealing with issues involving the governments of both countries. I made it clear, however, that this was an initiative to be undertaken by the Party, not by or on behalf of the government,” Golding said yesterday.
“A payment of US$49,892.62 was made to Manatt, Phelps & Phillips on September 18th 2009. These funds were sourced from financial contributors to the Party. Rumours and speculation carried in the media that these funds were provided by Christopher Coke are completely false as the Party is fully aware of the source of these funds,” he added.
Prime Minister Golding further insisted that there was “absolutely nothing illegally or surreptitious” about what had been done, arguing that the engagement of lobbyists to act on behalf of foreign governments, political parties or corporations is a well-known practice in the United States governed by law.
Golding has been strongly resisting the attempt to extradite Coke on the grounds that wire-tap evidence gathered by the US authorities in their case against him was illegally obtained.
He said that the Extradition Treaty between Jamaica and the US specifies the type of information that must be provided in support of a request for extradition and maintained that the information presented in the Coke matter is unacceptable because “it has been used in violation of Jamaican law and in contravention of the expressed order of a Judge of the Supreme Court”.
“For the (Justice) Minister to ignore this violation and issue the authorization to proceed would be to condone and legitimize this violation and would be a dereliction of duty,” he said, adding that although the Jamaica government wrote formally to the US authorities back in September 2009 requesting additional or separate information that would enable Justice Minister Dorothy Lightbourne to sign the authorization to proceed, the US has “steadfastly refused to do so”.
“I wish to make it clear that the government will, without hesitation, facilitate the extradition of any Jamaican citizen wanted to stand trial for extraditable offences once the obligations under the Treaty are met. Christopher Coke is wanted for an alleged crime in the US for which he ought to be tried and the government of Jamaica, consistent with its obligations under the Treaty, will do everything necessary to facilitate his extradition once it is done in accordance with the provisions of the Treaty and the laws of our country,” Golding told the Parliament.
“Some argue that this is a matter for the Courts and not the Minister to determine. They are wrong! As I have already pointed out, the Treaty makes it clear that information sufficient to allow the Minister to authorize extradition proceedings must be presented before the request is submitted to the Courts. What we have, therefore, is a dispute regarding the application of the Treaty. A treaty dispute cannot be resolved by the Courts of either party to the dispute. This is why we have used every conceivable means to resolve this dispute through dialogue with the US authorities.”
Prime Minister Golding said that since the controversy and the suggestion that the government's stand is motivated by partisan considerations, his administration retained the services of a senior attorney to seek a declaration from the Court as to the duties of Justice Minister Dorothy Lightbourne and the matters she must properly take into account in exercising her authority under the Extradition Treaty.
JLP parliamentarians yesterday blasted Golding for not acknowledging his involvement in hiring Manatt, Phelps & Phillips earlier.
But the Prime Minister insisted that he replied truthfully when asked whether the Government of Jamaica had engaged the law firm’s services.

Jamaican court to rule on US extradition request
The government is resisting US demands that it hand over Christopher "Dudus" Coke, citing what Golding has described as unauthorized wiretaps and other problems with evidence against him.
The Shower Posse has been blamed for hundreds of killings in the United States, and Coke is wanted on US arms and drug trafficking charges.
The premier told a call-in radio program on Wednesday night that he had asked Justice Minister Dorothy Lightbourne to send the eight-month-old request before a judge for a decision.
"I have instructed the justice minister to make an application to the court to seek a declaration to determine whether or not there was a breach of the law or the (extradition) treaty," Golding said.
Coke is a member of the ruling Jamaica Labour Party and holds considerable sway over Golding's volatile constituency in the inner-city district of West Kingston.
In its annual narcotics control strategy report issued last month, the US State Department criticized Jamaica's handling of the Coke matter and said pervasive public corruption was a major barrier to improving the country's counter-narcotics efforts.
"Jamaica's delay in processing the US extradition request for a major suspected drug and firearms trafficker with reported ties to the ruling party highlights the potential depth of corruption in the government," the report said.
Vivian Blake, founder of the Shower Posse, died of natural causes in a Jamaican hospital last month, about a year after returning from a prison term in the United States.
Coke is believed to be the new head of the gang, named for its alleged practice of cutting down rivals in a hail of gunfire in the cocaine wars of the 1980s.

Jamaica: Deceptions, dons and underdevelopment
It was Mahatma Gandhi who said "to believe in something, and not to live it, is dishonest". In election after election in post-Independence Jamaica our leaders have invited us to trust what they professed to have been their beliefs; but they have failed in almost every instance to live up to them. Gandhi would have condemned them all as dishonest.
We need only compare the ideals expressed by our recent prime ministers while campaigning for office to their actions when those beliefs were put to the test. The most recent and I believe most striking example of this is Bruce Golding's abrupt about-face on his professed abhorrence of garrison politics.
We should have known better. Many of us were prepared to put the most favourable interpretation on this 'new and different' Jamaica Labour Party (JLP) leader's choice of 'the mother of all garrisons' to be his home constituency; and were willing to believe that his purpose was to reform from within, and in so doing create a model on which all other garrisons could be reformed. But recent events have proven us to have been far too generous with our trust.
Two and a half years after coming to office, and 15 years since he walked away from the JLP and declared his independence from the garrison form of politics, Golding's constituency is as deeply steeped in garrison politics as it ever was.
In two and a half years as chief executive of our country, Mr Golding, despite his earlier strong human-rights advocacy, has missed every opportunity to take a public stand in defence of the rights of our citizens; that is until he was confronted by the case of Christopher Coke. His stout defence of Mr. Coke's rights, from all appearances at the risk of Jamaica's international relationships and economic well-being, speaks powerfully to the value he places on this individual.
Not that the Government is not duty bound to stand up to the mightiest of forces in defence of the rights of the least of our citizens. It is. Not that the Government does not have the right to deny an extradition request in Jamaica's public interest. It does. What is remarkable about the prime minister making Coke's extradition case his first notable effort to protect the rights of a Jamaican citizen is that he has obviously calculated that, notwithstanding the consequences to Jamaica, a greater interest is served by protecting Coke.
Since the prime minister's human-rights epiphany so strains credibility and logic, we are forced to conclude that he believes that Coke's protection is in the public interest; in which case he is allowed by the treaty to deny the request.
But what is it about Mr Coke that makes him so valuable? 'Dudus' Coke is widely believed to be the country's most prominent and effective practitioner of the garrison style of social and economic organisation. He is Jamaica's 'chief don' and commands the title 'President' in the area that he controls. What is the message conveyed to him and his 'subjects', to Jamaica and to the world, when a prime minister invests him with such high national value?
So much so that the Government now has to be defending allegations that it directly or indirectly engaged a firm of US lawyers to lobby the United States government, with a view to preventing his extradition. Doesn't this effectively provide the ultimate imprimatur for the activities for which Mr. Coke is notorious? And doesn't this seriously contradict the anti-don, anti-garrison beliefs Mr Golding earlier espoused?
For those of us who believe economic development cannot take place in a social and economic environment dominated by garrisons, this is a most frightening situation. Not simply because of our opposition to garrisons and dons, but because we recognise that the growing control of our society by garrisons and their dons has been a major cause of the underdevelopment of our economy and society. Their suppression of our people's 'unalienable right to life, liberty and the pursuit of happiness' is manifested in the growing lawlessness and fear under which we have lived since this freakish phenomenon began to engulf our society in the 1960s.
The right to life, liberty and pursuit of happiness is no less an entitlement of the Jamaican citizen than it is of the American. And the obligation to secure these rights for Jamaicans is as binding on the Jamaican Government as securing them for Americans is binding on the US government. But garrisons undermine the ability of Government to deliver on this obligation. Dons usurp the role of government, and have no purpose but to use the people under their control to secure and strengthen their own wealth and power.
They operate through patronage, intimidation and fear; it is never their purpose to secure freedom and opportunity for the people they control. Despite this, respective Jamaican governments have been prepared to condone and co-opt the garrison into their practice of politics, even while they grandly inveigh against them officially.
Social and economic freedom is at the core of successful economic activity. Without it, no effort by Government to promote investments, production and development will ever achieve the peace and prosperity our people crave. The garrison system not only denies our people these basic conditions, it sucks life and substance from the economy. It channels taxpayer-funded government contracts to dons, and feeds official corruption. The enforced 'protection services' of the dons is an unwanted and unproductive cost of doing public and private business, compounding the uncompetitiveness of our economy. They are a deterrent to production and the efficient functioning of the formal economy. Above all, the garrison form of organisation denies economic opportunity and employment for our people and leads them instead to a future of street scuffling, crime and servitude.

Garrisons must be seen and treated as what they really are: the means through which our people are kept enslaved and denied the right to be all that they can be. They will take us in the direction of Somalia, controlled by warlords, rather than Singapore, characterised by order and prosperity. They lead us towards backwardness and jungle justice, not modernity and the rule of law. The loud, clear and eloquent statement made by the prime minister by his stance in the Dudus affair is that he will pay any price and force the country to do likewise to protect the favourite don of his favourite garrison. In doing so, we may have crossed the Rubicon towards the utter failure of Somalia, rather than climb the first rung towards the success that is Singapore.
I do not know whether the prime minister will change direction before our final disintegration into the squalor of a failed state; but for Jamaica's sake, I hope that he or someone else will salvage the situation and pull us back towards sanity. Jamaica can still develop into a state which can deliver on the promise of freedom and the optimisation of human potential. But our approach to leadership must be radically changed.
This fiscal year, the Government spent almost 45 per cent of the country's output, and yet it could not provide the public goods and services that a modern democratic government is expected to deliver. When Government takes so much of what we produce, we have every right to expect top-quality affordable health care, education, water, electricity, public transportation, roads, public safety and justice.
We have every right to expect a social and economic environment that encourages and facilitates our hopes for economic upliftment. We have every right to expect our Government to foster a high-quality social capital that enables us to achieve levels of production that can create peace and prosperity. The Jamaican Government squanders much of our resources through general economic mismanagement, but has made the situation far worse by rendering itself hostage to dons and garrisons.
Now that the very leadership which we were led to believe was committed to breaking the links to these garrisons has instead elevated itself to a position of national importance, we seem to be perched on the precipice of social and economic disorder.
Our country desperately needs to be rescued. Do any of our political leaders have the honesty, moral authority, courage and political gravitas to make this change? Are there men and women who will live what they say they believe and summon the courage to act on those beliefs?
The Christopher Coke case has found our prime minister wanting. Can anyone else in the Government or the Opposition rise to the required standard of leadership? And will he or she speak up before it is too late?

Jamaica: Pastors, pulpits and politics

Dear Reader,
Over the years, I have been a constant public critic of the failures of the Jamaican church. While I have openly recognised and congratulated the church on its history and continued commitment to education and social outreach, I keep reminding those of us who are the body of Christ that the area of greatest weakness is that the church has failed to act as the conscience of the state. To put it another way, the church has been reluctant and afraid to speak truth to power.
The words of the late Rev Dr Martin Luther King, Jr are haunting. In the book, Strength to Love, King asserted: "The church must be reminded that it is not the master nor the servant of the state, but rather the conscience of the state. It must be the guide and the critic of the state, and never its tool."
It is clear that some of our Jamaican pastors have forgotten whom they serve, and the most recent case in which the Rev Al Miller, one of the country's most influential pastors, has sided with the government on the extradition of a reputed "drug lord" and community "strongman", is to my mind the most glaring example of pastors allowing themselves to be used as tools of the state.
One of the observations I have made concerning Prime Minister Bruce Golding and Rev Al Miller is how quickly they have both became converted to full-fledged human rights activists. In fact, they have all but eclipsed Jamaicans for Justice and the Independent Jamaica Council on Human Rights in this particular so-called human rights case. Never before have I heard a pastor and a politician achieve such unison of thought and purpose, and speak so eloquently and stridently about the human rights of any Jamaican citizen in a country where violating people's rights is an accepted way of life. Are we to understand from the pastor and the politician that the human rights of some Jamaicans are more important then the human rights of others?
Somebody needs to tell Rev Miller that the debate surrounding the extradition of Coke is best left to lawyers, judges, politicians and to those constituencies where morality is inapplicable and where the law is supreme and self-serving. In biblical terms, it is the divide between the teachings of Jesus Christ and the system of Rome. One examined the soul of man, while the other was sworn to the service of Caesar.
There must be a greater motive unknown to us that would cause a pastor to ignore the brutality associated with "strongmen", and choose instead to focus on the "principle" of the extradition matter. I am reminded of a recent case where the accused rapist of a nine-year-old girl was set free because of a technicality involving DNA evidence. The question for the pastor is, where would you focus - on the horror of the crime or on the technicality of the law? What Rev Miller doesn't seem to realise is that lawyers have no responsibility to debate morality, but as a pastor he is absolutely obligated to doing so.
In fact, it is the moral failings of Jamaican society in general, and our political leaders in particular, which should be the concern of every pastor, let alone one who sits at the right hand of the prime minister. Instead of focusing on an issue that is best left to constitutionalists, lawyers and judges, Rev Miller ought to be speaking about the social ills in the society that have led to the ascendancy of "strongmen" and drug lords. The question that should be exercising the mind of every Jamaican pastor is, how do we build a society in which we can strengthen family life, protect our children and promote a consistent ethic of human life? Rev Miller needs to be reminded that if God is not at the centre of national life, then we can never achieve human rights.
Instead of "selling out" to man's politics, Rev Miller should be steadfastly focusing on perpetuating God's politics, and should make note of the fact that any discourse that is disconnected from moral values quickly degenerates.
Rather than "parroting" the government's position on the extradition, Rev Miller should be calling the leaders to a higher moral standard which dictates that they clean up and dismantle their garrison communities so that the murder and abuse of citizens will end, and that the scourge of strongmen will be cauterised and eventually eliminated.
Rev Miller should be calling for a deeper discourse about vision and values in public life. He should be speaking about how a new vision for the common good could inspire us all to lives of service and to a whole new set of public priorities.
Instead of pandering to politicians, Jamaica's pastors should heed the words of Rev Martin Luther King who warned that "if the church does not recapture its prophetic zeal it will become an irrelevant social club without moral or spiritual authority". In his book, God's Politics, author Jim Wallis asks, "Who will question the self-righteousness of nations and their leaders? Who will not allow God's name to be used to simply justify ourselves, instead of calling us to accountability? And who will love the people enough to challenge their worst habits, coarser entertainments, and selfish neglects?
I would implore Rev Miller to ponder on those things and to keep in mind that politics without a soul is anti-God. He should bear in mind too that pastors and politicians can make strange bedfellows.

Jamaica: Extradition or not ... Coke is it!

Christopher 'Dudus' Coke will remain on the United States most-wanted list even if he is not extradited by the Jamaican authorities.
An official of the US Attorney's Office says the west Kingston strongman known as the 'President' will remain a priority for American law-enforcement agencies even if the Bruce Golding administration decides not to send him to America for trial based on the present extradition request.
"The indictment and the extradition are two separate things. The indictment is the charges against him, and the charges still stand," said Rebekah Carmichael, who is attached to the United States Attorney's public information office for the Southern District of New York.
Carmichael told The Sunday Gleaner: "The indictment still stands whether a defendant is extradited or not. The indictment continues to exist, the charges continue to exist."
As a result, Coke remains on the US Department of Justice's list of Consolidated Priority Organisation Targets, which includes the world's most dangerous narcotics kingpins.
No comment
Carmichael declined to say what measures US authorities were prepared to implement to ensure that Coke faces the court. "I would not be able to comment on that, we have no comment," she said.
She also refused to comment on the Jamaican Government's decision not to sign the request for the extradition of Coke.
At the time the indictment was issued against Coke, Preet Bharara, United States Attorney for the Southern District of New York, described the charges against him as "another important step in our bringing to justice the world's most dangerous criminals, wherever they may be found".
Coke is "charged with conspiracy to distribute cocaine and marijuana and conspiracy to illegally traffic in firearms. If convicted on the narcotics charge, he faces a maximum sentence of life in prison, as well as a fine of up to (US)$4 million, or twice the pecuniary gain from the offence," read a section of a release issued by the US Attorney's Office last August.
Since then, Prime Minister Bruce Golding has argued that that there is an insufficiency of credible evidence to substantiate a criminal charge against Coke, and that the other available evidence was obtained in breach of the Interception of Com-munications Act, 2002.
While the prime minister did not rule out honouring the extradition request, he argued that the Government would have to be presented with information in accordance with Jamaican law.
The Government has also asked the US authorities to disclose the name of the police officer who passed the intercepted communication to them.
Under local laws, the policeman, so far identified only as 'John Doe', was not authorised to pass the information to the US authorities and committed a criminal offence.
But so far, the Americans have refused to disclose the name of the police officer or state if he is still in Jamaica.
This has led to a stalemate, which the US argues, can be resolved by placing the extradition request before the Jamaican courts, while the Golding administration claims that both parties should sit and try to arrive at an amicable solution.

Jamaica: Golding's 'Dudus' dilemma

Currently, Jamaica is in danger of becoming something of an international pariah. We were recently downgraded economically by both Bear Stearns and Moody's and also downgraded morally by Transparency International, but these are mere niceties in face of the thing that is threatening to demote us to the status of banana republic or rogue state.
This of course is the face-off between the Jamaican Government and the United States (US) in the matter of the extradition of Christopher 'Dudus' Coke. The media are treating the matter gingerly, but already, two companies have received threats from his fans. The public seems to have adopted the attitude that the prime minister (PM) is between a rock and a hard place and is sitting back to watch. The circumstances deserve more attention.
Our seemingly unflappable PM is actually on a slippery slope teetering on the edge of an International Monetary Fund rejection and simultaneously trying to find a foothold as he walks barefoot along the razor's edge between antagonising the US and infuriating his volatile constituents, plus night and day wondering where he is going to find the next few billions to pay the nurses, or the teachers, or the police. And he is handling this ticking time bomb with all the aplomb of a pope - or someone who has O.D'd heavily on tranquillisers. The man is an enigma wrapped in a mystery. One has to applaud his phenomenal cool, but who can understand it?
Whatever one's opinion about the delay on the request to extradite Coke (and other unnamed prominent persons) to face drug and gun charges, any intelligent person must be aware of the gravity of the situation and the impact that the displeasure of the US will have and indeed may already be having on Jamaica's viability. Keep Coke, and we get the big stick from the leader of the free world; hand him over, and we may be able to repair some of the damage to our image and some access to meaningful economic assistance. It is not only the right thing to do, but the only sensible course to take.
Thus, it does appear that Bruce Golding and Dorothy Lightbourne would be best advised that for the good of this country they stop the legal titivating and filibustering and just hand over the multifaceted Mr Coke aka 'Dudus', 'Prezi' or 'The President'.
In Jamaica, Dudus is described as a businessman, show promoter, area leader and don; but in the US, the State Department is alleging that he is an illegal gun trader and a purveyor of dangerous and illegal drugs.
Of course, handing Coke over to the US authority will be unpleasant and possibly have some perilous consequences for residents, for Golding, and by extension, for the Jamaica Labour Party (JLP).
Risking civil unrest
Residents may suffer civil unrest, Golding may lose support in his constituency and could even lose his seat in the next election. Trouble is likely if Coke is indeed as popular, powerful and dangerous in this JLP garrison as he is made out to be. But is this really the case? Is it fear or love that controls his supporters? There may well be a large number of well-thinking residents who would prefer to live outside the shadow of a don.
If, as predicted, the removal of Dudus does cause riot and mayhem in Tivoli, it will be the job of the police (hopefully without the help of Reneto Adams) and the army to quell it. Are the prevalent rumours of plans for protests and insurrection and of Tivoli bristling with high-powered weapons true, or just greatly exaggerated? If they are true, is that not another good reason to send in the troops?
No two ways about it: the Dudus dilemma does present an enormous challenge to Golding, and by extension, to the JLP, and more important, to all Jamaica. Perhaps Golding sees the stand-off as a no-win situation in which he is damned if he does and damned if he doesn't comply with international law and surrender the don to the US justice system. If Tivoli's response to the extradition is riot and mayhem and Golding has to send in the troops and invoke the Suppression of Crimes Act or call a State of Emergency just before the start of the tourist season, that's another blow to the economy and a double whammy to the economy and the JLP government.
Massive challenge
On the other hand, this massive challenge does come with a huge and enticing opportunity, an opportunity which, if intelligently and energetically used, can rid our island of a curse and transform Golding himself into a genuine National Hero.
Simply put, by cutting Dudus loose, Golding has a God-give opportunity to strike a crippling blow (hopefully the first of many such) against the corrupt gangland culture of the dons, which has taken over our many garrison constituencies, infiltrated mainstream politics, and is now threatening to get a stranglehold on both politics and society in Jamaica, land we love. Which politician would not rather become a National Hero than play second fiddle to a garrison don?
